The chairman, Paul Lothrop ,opened the meeting at 3:10
I. PUBLIC HEARING ON ADOPTION OF A CHANGE IN RENTAL FEES
The Selectman at their Monday meeting March 21,2005 voted to change the rental occupancy fee from $20 to $30. The Town Clerk requested the Board of Health vote to adopt this change. Dr. Taylor made the motion to approve the new fee $30. Joyce Gibson seconded the motion
VOTE WAS 4-0 FOR APPROVAL
The Board also decide to eliminate the fee amount from the Health regulations Section III ( page 27 - number-3)
OPENING STATEMENTS:
The Health Agent also submitted copies of letters sent to Ms. Deloconte
55 Maurice Road and Mr. Haffa 50 Old Orchard Drive concerning their underground storage tanks. The tank at Old Orchard Road is 20 years old and the tank at 55 Maurice Road is 35 years old and these tanks have never been tested for leakage. The Eastham Board of Health is now requiring that these underground tanks be tested within 60 days of receipt of these letters before legal action and penalties incur.
VARIANCES
Goldstein 240 Corliss Way Map-7 Parcel-18
Terry Ryder (Ryder/Wilcox) presented the plans to upgrade the septic system. The variance requested is as follows:

C. Septage Disposal Regulations
Proposed SAS will be located 75 feet from a vegetated wetland where 100 feet is required. A 25 foot variance is requested.
Finding that the plan achieves maximum feasible compliance, the aforementioned variances were approved with the following conditions:
1. No increase in flow allowed
2. Deed restriction to 4 bedrooms
3. Well to be tested for Voc and Routine parameters
4. All covers to be within 6" of finished grade
The Board of Health also wanted to note that the wetland is isolated and of limited environmental significance .
Stan Holt made the motion to approve the plan with the 4 conditions. Dr.Taylor seconded the motion. THE VOTE WAS 4-0 FOR APPROVAL
Shepard 3129 State Highway Map-12 Parcel-58
John O’Reilly (Bennett &O’Reilly) presented a plan to upgrade the septic system. The plan includes secondary treatment with a Microfast 0.5 unit.The variances requested are as follows
Local Upgrade Approvals - Title 5 & Eastham Board of Health Regulations:
310 CMR 15.211 - Setbacks
The proposed soil absorption system is not 10' from property line;
8.0'held 2'variance requested (Northwest)
4.0'held 6' variance requested (Northeast)
Finding that the plan achieves maximum feasible compliance, the aforementioned variances were approved with the following conditions:
Routine water quality test results be provided of existing well location to assure potability
No increase in design flow be allowed
Secondary treatment and monitoring under general use approval conditions per DEP regulations including testing quarterly for total nitrogen, BOD, TSS, Nitrate (or 2 times per year for seasonal use). After this time reduction of testing could be requested to BOH by owner.
Operation and maintenance agreement to be required for life of the system.
Deed restriction for 2 bedroom use and use alternative technology requirement to be recorded on deed.
Designer to verify proper operation of the system to issuance of Certificate of Compliance
Stan Holt made the motion to approve the plan with the 6 conditions.
Joyce Gibson seconded the motion.
THE VOTE WAS 4-0 FOR APPROVAL
3. Grant 55 Eldredge Drive Map-1 Parcel-54

Tim Brady and Attorney, Duane Landreth requested the Board approve the plan submitted by East Cape dated 8/25/05. This plan was denied at the BOH Meeting. September 29, 2005 and the Board recommended an alternative system be added to the design.
The Health Agent recommended this plan be denied again since the plan is not a shared system.. She would recommend approval with the use of an alternative treatment added to a shared septic system
with the following conditions:
Voc and routine water quality test results be provided of proposed well location to assure potability
No increase in design flow be allowed
Secondary treatment and monitoring under shared system use approval conditions per DEP regulations including testing quarterly for total nitrogen (or 2 times per year for seasonal use). After this time reduction of testing could be reequested to BOH by owner.
Operation and maintenance agreement to be submitted to the Eastham board of Health. Operation and maintenance agreement to be required for the life of the system.
Deed restricition for 3 bedrooms on each lot served and alternative technology requirement to be recorded.
Designer to verify proper operation of the system prior to issuance of Certificate of Compliance.
Subject to Conservation Commission review
Subject to DEP approval for shared system
Stan Holt made the motion that this hearing be continued until new plans be submitted at the December 29, 2005 meeting. Dr. Taylor seconded the motion the motion.
THE VOTE WAS 4-0 FOR CONTINUATION
Review of Alternative System to be added to existing system requested by BOH at the August 25, 2005 Meeting
Crockett
Stephanie Sequin (Ryder/Wilcox) presented the plan to upgrade the septic system which includes Microfast 0.5 unit under general use approval. Since this is an environmentally sensitive lot the building project was subject to Board of Health review. At their meeting July 28, 2005 the Board required secondary treatment be added . This property has a title 5 system that was installed in 12/7/00 with a well set back variance and is determined to be an environmentally sensitive lot. The system has a capacity for 3 bedrooms. The proposed dwelling has a full basement and a second floor which will have 3 bedrooms.
Finding that the plan achieves maximum feasible compliance, the aforementioned variances were approved with the following conditions:
1. No increase in design flow be allowed
2. Secondary treatment and monitoring under general use approval conditions per DEP regulations including testing quarterly for total nitrogen, BOD, TSS, Nitrate (or 2 times per year for seasonal use). After this time reduction of testing could be requested to BOH by owner
3 Operation and maintenance agreement to be submitted to Eastham Board of Health. Operation and maintenance agreement to be required for life of the system. Operator to report results via Carmody Data Base provided through Barnstabel County Health or directly to the Eastham Health Department if not available.
Deed restriction for 3 bedroom use and use alternative technology requirement to be recorded on the deed.
5. Designer to verify proper operation of the system prior to issuance of Certificate of Compliance
Any increase in habitable square footage would require Board of Health review
7. Well disclaimer form to be signed by the owner.
Stan Holt made the motion to approve the plan with the 7 conditions.
Dr. Taylor seconded th motion.
THE VOTE WAS 4-0 FOR APPROVAL
